At any time, RE Wave may change, modify, add or remove portions of these terms by posting updated versions. You shall also be notified about any changes via e-mail. In the event that you continue to use the platform after such changes have been made, you are considered to have accepted those changes.

Your privacy is important to us, and you can trust that any information we use and share about you will be handled carefully and sensibly. It is possible that the user will be asked for personal information even though most of the information on this site is available without providing personal information. The information we collect about our customers is an important aspect of our business, and we do not do business with others by selling their personal information. When you use RE Wave services, or send e-mails, text messages, and other communication from your desktop or mobile device to us, you may be communicating with us electronically. You consent to receive communication from us electronically. This includes e-mails, texts, mobile push notices, or notices and messages on this site. You agree that all agreements, notices, disclosures, and other communication that we provide to you electronically, satisfy any legal requirement that such communication be in writing.

Subject to your compliance with these Conditions of Use and any Service Terms, and your payment of any applicable fees, RE Wave or its content providers grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal and non-commercial use of the RE Wave services. This license does not include any resale or commercial use of any RE Wave service, or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of any RE Wave service or its contents; any downloading, copying, or other use of account information for the benefit of any third party; or any use of data mining, robots, or similar data gathering and extraction tools. RE Wave or its licensors, suppliers, publishers, rightsholders, or other content providers retain all rights not expressly granted to you in these Conditions of Use or any Service Terms.No RE Wave service, nor any part of any RE Wave service, may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of RE Wave. Without RE Wave's express written consent, you may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form). Using RE Wave's name or trademarks in meta tags or other hidden text is prohibited without the express written consent of RE Wave. You may not misuse the RE Wave services.You may use the RE Wave services only as permitted by law. The licenses granted by RE Wave terminate if you do not comply with these Conditions of Use or any Service Terms.

Upon visiting RE-wave.com, you will have the option of creating an account. Following the onscreen instructions will enable you to create an account. Make sure that you choose a username and password that will only be accessible by you. When submitting your registration you need to indicate that you accept the terms and conditions. Once we receive your registration request, we will review it and decide whether to accept it or not. Reviews are usually completed within 48 hours. Our registration team will be able to contact you, in case there are any questions regarding your registration, if you enter your mobile phone number. Once the review process has been completed and access to RE Wave has been granted or denied (for whatever reason), you will be notified via email.

Whenever a user makes a transaction with respect to the purchase or sale of renewable energy or renewable energy assets through the platform, additional terms and conditionswill apply that are specific to such transactions, and the user will need to agree to such additional terms before a transaction can be consummated. 

The RE Wave platform is a software-as-a-service offering. Successful Power Purchase transactions will result in Think RE charging success fees, either to the seller, or to the buyer, or to both. The users acknowledge this and agree to pay invoices from Think RE and RE Wave on time. With other functionalities other fees might be charged, this however, will be subject to specified contract not being subject to these terms.

Subject to these terms, RE Wave may, at its sole discretion, remove any data from or revoke access to the platform for any reason, or no reason, without liability or penalty.

In accordance with this contract, we are not to be held liable for any loss of revenue oranticipated savings, loss of contracts, loss of profit, loss of business, lossof software, data, or information, or any special, indirect, or consequential damages of any kind. There will be no responsibility and no liability on our part arising from disputes between you and any other third-party, including the developers of Projects. Any advice, opinion, statement of expectation, forecast or recommendation supplied by us shall not amount to any form of guarantee that we have determined or predicted future events or circumstances.

RE Wave is accessed and used at the risk of the user, except as explicitly stated in the terms and conditions. There is no guarantee of results when using the platform from RE Wave. Especially in the participation of green procurement tender processes. The actions andinactions of sellers and buyers using the platform are their responsibility.RE Wave does not haveto provide access to the platform for a specific period, nor is it obligated to maintain or further develop it.

This contract can beterminated at any time by either you or us by giving notice in writing to the other party. In addition to anyother rights that we have, we may suspend your access to the platform, orterminate the contract with immediate effect by giving you written notice.

Unless otherwise required by a mandatory law of any other jurisdiction, these terms will be governed by the laws of Germany, excluding its conflict of laws principles.  It should be notedthat if any provision or portion of the terms is found to be invalid or unenforceable under any applicable statue or rule of law, it shall be deemedomitted only in its entirety, and any invalidity or unenforceability shall notaffect any other provision of the terms.
